The focus was on two key questions: whether certain design defects and a staff shortage during baggage handling could be classified as extraordinary circumstances.<\/p>\n<p><strong>Design Defects<\/strong><\/p>\n<p>As established in the landmark <em>Wallentin-Hermann<\/em> case (<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=CE555172CFC6E635FBD39865DD5BE006?text=&amp;docid=73223&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=752480\">C-549\/07<\/a>), hidden manufacturing defects may constitute extraordinary circumstances. In 2024, the ECJ provided further clarity in two significant cases involving design defects:<\/p>\n<ul>\n<li><strong>Case <a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=B573E7857BADB5784957572C2E33900F?text=&amp;docid=287074&amp;pageIndex=0&amp;doclang=EN&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=3527055\">C-385\/23<\/a>:<\/strong> A design defect in the fuel gauge of a newly introduced aircraft model.<\/li>\n<li><strong>Case <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/HTML\/?uri=CELEX:62023CJ0411\">C-411\/23<\/a>:<\/strong> A design defect in the engine, reported to the airline months prior to the incident.<\/li>\n<\/ul>\n<p>In both instances, the ECJ ruled that the design defects in question qualified as extraordinary circumstances. The Court reasoned that such defects, discovered post-entry into service, constitute hidden manufacturing defects that jeopardize flight safety. Since airlines have no control over such defects\u2014discovered by manufacturers only after delivery\u2014they fall outside the normal scope of an air carrier&#8217;s operations.<\/p>\n<p>Of particular note, in <em>Case C-411\/23<\/em>, the ECJ emphasized that the timing of the airline\u2019s awareness of the defect was irrelevant. What mattered was that the defect existed at the time of the cancellation and was beyond the airline&#8217;s control.<\/p>\n<p><strong>Staff Shortage for Baggage Handling<\/strong><\/p>\n<p>The <em>Touristic Aviation Services<\/em> case (<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=715B30701B9019089CAE67D25CB50271?text=&amp;docid=286148&amp;pageIndex=0&amp;doclang=EN&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=5604224\">C-405\/23<\/a>) examined whether a staff shortage at an airport operator responsible for baggage handling could be classified as an extraordinary circumstance.<\/p>\n<p>Here, the ECJ built upon principles established in the <em>SATA International<\/em> case (<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=262431&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=753049\">C-308\/21<\/a>), which dealt with the failure of an airport operator&#8217;s refueling system.
